Dezintermediacja z perspektywy ekonomii tokenów nieruchomości

Abstract

Purpose: This article examines the issue of disintermediation through the example of real estate investing with tokens. The aim is to determine whether, and to what extent, intermediaries can be removed in blockchain‑based property investments.

Methodology: The analysis is based on secondary data from fields such as token economics, management, legal science, and sociology. An analytical and deductive approach was used, drawing on interdisciplinary literature reviews and data from selected company websites involved in real estate tokenisation.

Results: It was found that the idea of fully removing the intermediation of public and private institutions (agencies, notaries, courts) in real estate tokenisation remains a proposal. The extent of disintermediation varies and depends on numerous factors: legal, organisational, political, and technological. Simultaneously, reintermediation and the evolution of the roles of transaction intermediaries are observed. Intermediary functions are still carried out traditionally (by notaries, land and mortgage register courts, and law firms), as well as by new entities such as tokenisation platforms, issuers, and token operators. The system is supported by a new ecosystem of digital intermediaries who ensure the security, legal compliance, and functionality of investments.

Research Limitations/Implications: The phenomenon is still in its early stages; many issues require further investigation, and the practical outcomes of tokenisation for various specific properties remain unclear. The work does not include detailed case studies or analyses of token trading on exchanges.

Originality/Value: The work shows that the proposed disintermediation is currently being replaced by reintermediation. New intermediaries are taking over roles of traditional agents, while traditional intermediaries still retain some functions. The main legal, organisational, and technological problems requiring further research have been identified.

Cel: w artykule analizowany jest problem dezintermediacji na przykładzie inwestowania w nieruchomości z wykorzystaniem tokenów. Celem jest odpowiedź na pytanie czy i w jakim zakresie możliwa jest eliminacja pośredników w nieruchomościowych inwestycjach blockchainowych.

Metodologia: analiza jest oparta na danych wtórnych z zakresu ekonomii tokenów, zarządzania, nauk prawnych i socjologii. Zastosowano metodę analityczną i dedukcyjną, wykorzystując interdyscyplinarne studia literaturowe oraz dane z wybranych stron internetowych firm zajmujących się tokenizacją nieruchomości.

Wyniki: ustalono, że idea całkowitej eliminacji pośrednictwa instytucji publicznych i prywatnych (agencji, notariuszy, sądów) w przypadku tokenizacji nieruchomości pozostaje w sferze postulatów. Faktyczny zakres pośredniczenia jest różny i zależy od wielu czynników: prawnych, organizacyjnych, politycznych i technologicznych. Jednocześnie obserwuje się reintermediację, ewolucję ról pośredników transakcji. Funkcje pośredniczące są nadal wykonywane tradycyjnie (przez notariuszy, sądy wieczystoksięgowe, kancelarie prawne), a także przez nowe podmioty, takie jak platformy tokenizacyjne, emitentów i operatorów tokenów. System jest obsługiwany przez ekosystem nowych pośredników cyfrowych, którzy zapewniają bezpieczeństwo, zgodność z prawem i funkcjonalność inwestycji.

Ograniczenia/implikacje badawcze: zjawisko jest in statu nascendi; wiele zagadnień wymaga dalszych badań, a wyniki praktyczne tokenizacji wielu konkretnych nieruchomości są niejednoznaczne. Praca nie obejmuje szczegółowych studiów przypadków ani analiz obrotu tokenami na giełdach.

Oryginalność/wartość: w pracy wykazano, że postulowaną dezintermediację zastępuje obecnie reintermediacja. Są nowi pośrednicy przejmujący funkcje tradycyjnych agentów, pozostają też w pewnym zakresie pośrednicy tradycyjni. Wskazano główne problemy prawne, organizacyjne i technologiczne wymagające dalszych badań.
