Abstract
The article focuses on the procedural aspects of soft law tools employed by competition authorities in Europe, in order to help businesses advance sustainable development. In response to global challenges, such as the climate crisis, some authorities have introduced guidelines and informal guidance to enable companies to undertake pro-environmental collaboration, without breaching competition laws. Examples include guidelines from the European Commission, as well as those from the UK, Dutch, and French competition authorities. The article examines how effective these tools are, their impact on legal certainty for businesses, and explores how a similar approach could be implemented by the Polish Competition Authority (the President of UOKiK).
Abstrakt
Artykuł koncentruje się na prezentacji zagadnień proceduralnych dotyczących instrumentów prawa miękkiego stosowanych przez europejskie organy ochrony konkurencji, które mają na celu wspieranie przedsiębiorców w działaniach na rzecz zrównoważonego rozwoju. W odpowiedzi na globalne wyzwania, takie jak kryzys klimatyczny, niektóre organy wprowadziły wytyczne i nieformalne wskazówki, aby ułatwić przedsiębiorcom prośrodowiskową współpracę bez naruszania przepisów prawa konkurencji. Przykłady takich działań obejmują wytyczne Komisji Europejskiej, brytyjskiego, niderlandzkiego oraz francuskiego organu ochrony konkurencji. Artykuł analizuje efektywność tych instrumentów, ich wpływ na pewność prawną przedsiębiorców oraz rozważa, na ile podobne podejście mogłoby być zastosowane przez Prezesa UOKiK w Polsce.
