Abstract
The purpose of this article is to identify the reasons underlying the very liberal approach to State aid granted to postal operators. The analysis is based on the current position of the European Commission and the Court of Justice of the European Union in cases concerning State aid granted in the form of compensation for the provision of postal universal services. Widespread digitalisation has led, in recent years, to a significant decline in demand for certain traditional postal services – in particular the transmission of letters. This development is not limited to private correspondence, but also results from the expansion of digital public administration services. At the same time, electronic commerce has contributed to the substantial growth of another segment of the postal sector, namely parcel delivery services. Nevertheless, from an overall perspective, the scale of traditional postal services has been decreasing year on year. Despite the fact that the volume of postal services provided currently represents only a small fraction of their former scale, postal operators offering basic postal services – universal services – continue to operate in the Member States of the European Union. In many cases, the provision of such services is possible only as a result of various forms of support granted directly by the State or by entities under its control. For this reason, State aid rules play a key role in the financing of postal services. The article examines the current approach of the EU institutions to the interpretation of State aid rules in cases involving the granting of individual aid to postal operators in connection with the provision of postal universal services.
