Abstract

This article quotes the facts described in the judgment of the Polish Supreme Administrative Court (NSA) of February 17, 2023, fi le ref. file: II GSK 1458/19. The commented judgment is of great importance for the Polish hotel market, as it concerns the possibility of issuing, under the current legal regime, of decisions repealing the classification and categorization of an entity as a hotel facility and to its removal from the relevant register of hotel facilities, when it is established that the entity in question does not meet the requirements of fire, sanitary or construction safety. The constitutionality of the current legal provisions is assessed in the discussed judgment.

Abstrakt

W niniejszym artykule przytoczono stan faktyczny opisany w wyroku Naczelnego Sądu Administracyjnego (NSA) z dnia 17 lutego 2023 r., sygn. akt: II GSK 1458/19. Glosowane orzeczenie ma duże znaczenie dla rynku hotelarskiego w Polsce, dotyczy bowiem możliwości wydawania w obecnym stanie prawnym decyzji o uchyleniu zaszeregowania i kategoryzacji oraz wykreśleniu z ewidencji obiektu, który nie spełnia wymogów przeciwpożarowych, sanitarnych lub budowalnych. W omawianym wyroku mamy do czynienia z oceną konstytucyjności obecnych regulacji prawnych.
