Abstract

The Portuguese Climate Framework Law of 2021 has been underassessed by legal scholars. Therefore, the purpose of this article is to evaluate it through an energy lens. Through a close analysis of the legal text, the article seeks, firstly, to determine how the climate-energy relationship is treated, and then to understand the challenges that arise in implementing this Law, especially its interaction with the Environmental Policy Basis Law of 2014.

Abstrakt

Portugalska ustawa ramowa o klimacie z 2021 roku wciąż pozostaje niewystarczająco przeanalizowana w doktrynie prawa. Dlatego zasadniczym celem niniejszego artykułu jest poddanie jej ocenie z perspektywy polityki energetycznej. Na podstawie szczegółowej analizy przepisów ustawy podjęto próbę, po pierwsze, ustalenia, w jaki sposób kształtowana jest relacja pomiędzy polityką klimatyczną a energetyczną, a po drugie – identyfikacji głównych wyzwań związanych z implementacją analizowanego aktu prawnego, ze szczególnym uwzględnieniem jego interakcji z ustawą o podstawach polityki środowiskowej z 2014 roku.
