Abstract

The purpose of this article is to determine the scope of the essential facilities doctrine for single firm conduct in the area of EU law. The analysis of this issue was carried out using the following methods: dogmatic, comparative and historical. Based on the economic foundations of competition law, a set of boundary conditions for imposing an obligation on the undertaking occupying dominant position to provide facilities in order to protect downstream competition was formulated. This was followed by a review of key decisions of the Supreme Court of the United States on the essential facilities doctrine, which concluded that its scope went beyond outright refusal of supply. In turn, an analysis of CJEU case law and EU soft law led to the conclusion that the scope of the obligation to supply was broadened under EU law, in contrast to its evolution in the United States. The abovementioned studies allowed the conclusion that the doctrine of essential facilities under EU law is applicable not only in the situation of an outright refusal to supply, but also in the case of at least a constructive refusal.
