Abstract

The article addresses the legislator’s concept of a material approach regarding the legal defi nition of an entrepreneur in the Polish Act on package travel and linked travel arrangements of 24 November 2017. The Author presents the evolution of the material character of the analyzed provisions in EU legislation, giving special attention to the ECJ ruling in the Motosykletistiki Omospondia Ellados NPID of 1 June 2008. The Author also shows the evolution of the legal defi nition of an entrepreneur during legislative works on the Polish Act on package travel and linked travel arrangements.

Abstrakt

Artykuł przedstawia koncepcję przedmiotowego podejścia ustawodawcy do pojęcia „przedsiębiorcy” ujętego w ustawie z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych. Autor zaprezentował ewolucję przedmiotowego charakteru analizowanych przepisów w prawodawstwie unijnym oraz zwrócił uwagę na przełomowy w tym zakresie wyrok TSUE z dnia 1 lipca 2008 r. w sprawie Motosykletistiki Omospondia Ellados NPID przeciwko Elliniko Dimosio (państwu greckiemu). W ramach rozważań przedstawiono zmiany definicji przedsiębiorcy turystycznego na etapie prac legislacyjnych nad ustawą o imprezach turystycznych i powiązanych usługach turystycznych.
