Abstract

The purpose of the article is to discuss the Resolution of the Polish Supreme Court of 11 September 2020, III CZP 80/19, where the Supreme Court decided that the request to cancel a contract provided for in Art. 12 sec. 1 point 4 of the Act of 23 August 2007 on Counteracting Unfair Market Practices is a form of a claim for the restoration of the previous state, the effective investigation of which depends on the fulfilment of general conditions for liability for damages. The article includes an analysis of the positions presented so far in the doctrine and jurisprudence, as well as a commentary on the resolution adopted by the Supreme Court. Moreover, the impact of the ruling on the subsequent practice of common courts is presented.

Abstrakt

Celem artykułu jest omówienie uchwały Sądu Najwyższego z dnia 11 września 2020 r., III CZP 80/19, w której Sąd Najwyższy uznał, że żądanie unieważnienia umowy przewidziane w art. 12 ust. 1 pkt 4 ustawy z dnia 23 sierpnia 2007 r. o przeciwdziałaniu nieuczciwym praktykom rynkowym jest postacią roszczenia o przywrócenie stanu poprzedniego, którego skuteczne dochodzenie jest uzależnione od spełnienia ogólnych przesłanek odpowiedzialności odszkodowawczej. Artykuł obejmuje analizę stanowisk prezentowanych dotychczas w doktrynie i orzecznictwie oraz komentarz podjętej przez Sąd Najwyższy uchwały. Ponadto, zaprezentowany zostanie wpływ orzeczenia na późniejszą praktykę sądów powszechnych.
